Possible Lawsuit against ford motor company?

On my 2002 ford focus when i was driving today with no noise or possible warning my left rear wheel detached from my vehicle. The Lug nuts where still connected to the wheel as well as half of my drum brake. There is an investigation against ford by the NTHSA about this problem. I wasn't aware of the recall untill it happened to me. This website http://www.safetyforum.com/fordfocus/recalls.html is an example of this problem. Typing ford focus wheel falling off in google will provide plenty of examples. I had just taken the car taken to the ford dealership to fix a different recall. Is it there fault for not fixing this one? Luckly i was only going 25 on a paved road nobody uses . i could of possibly died because of this. What should i do?
